General Terms 1. By using or registering as a Yogurberry Loyalty card holder, you consent to the terms and conditions outlined in this agreement. 2. To enjoy the benefits of the Yogurberry loyalty program, you are required to provide Yogurberry with a valid email address. However, on completing the registration form you can select not to receive emails from Yogurberry. 3. Yogurberry accepts no responsibility for incorrect information provided by Yogurberry Loyalty card holders on web forms or the like. 4. Only one Yogurberry Loyalty card and account is permitted per person or email address. 5. Unless otherwise required by law or permitted by this agreement, Credit Points are non-refundable and cannot be redeemed for cash. No interest or any other earnings on funds on a Yogurberry Loyalty card will accrue, be paid or be credited to you by Yogurberry. 6. Yogurberry reserves the right to refuse use of a Yogurberry loyalty card on suspicion of unauthorised, fraudulent or otherwise unlawful use. Where this occurs, the account and card will be cancelled and any Credit Points will be lost. 7. Yogurberry reserves the right to change these terms and conditions at any time without notice. Rate of Reward 8. Australian dollars are the currency of Yogurberry and will be referred to as Credit Points. Credit points are not legal tender and cannot be used by any other means other than Yogurberry. 9. Yogurberry Loyalty card holders earn in Yogurberry credit points and spend (redeem) in credit points. 10. Yogurberry reserves the right to change the rate of reward and value of Yogurberry credit points at any time. 11. As of the 14th of August 2014, for every 1 Yogurberry point you earn, you will receive $0.01 value of yogurberry purchases. A minimum of 500 Points must be accumulated before spending. Earning Yogurberry Credit Points 12. To earn Yogurberry Credit points, you must first collect a Yogurberry card from any Yogurberry store and present the card during your transaction. 13. Participants must register their card at www.yogurberry.com.au/activate before redeeming Yogurberry points for use in purchases. 14. For every purchase made, you will be awarded 10% Yogurberry Credit Points of the total purchase amount (AUD) spent in a single transaction. Redeeming Yogurberry dollars (Credit Points) 15. To redeem Yogurberry Credit points, you must meet the following criteria; o a) Collect your Yogurberry Loyalty card from any participating store. o b) Go online to www.yogurberry.com.au/activate and register your details by completing all required fields. o c) Earn at least 500 Yogurberry credit points. 16. Credit Points are redeemable for rewards which consist of any food or beverage products within any participating Yogurberry Store (subject to availability) at the retail price in-store. 17. Yogurberry Credit Points cannot be purchased. 18. Yogurberry Credit Points can only be earned through accruing Yogurberry Loyalty points. 19. As of 14th of August 2014, rewards are redeemed at a rate of 1 Yogurberry Credit point to $0.01 AUD. Lost or Stolen cards 23. In the case of a lost or stolen card, you should: o a) Visit any Yogurberry Store and request a new card. o b) Log onto www.yogurberry.com.au/activate using your existing username (email address) and password, select the ‘card replacement’ tab and follow the prompts to link your existing Yogurberry credit points to your new card. 24. Yogurberry will take reasonable steps so that any Yogurberry credit points on the lost or stolen card are transferred to the new card, however Yogurberry will not be held responsible for any Credit points that are lost in the transfer. 25. Yogurberry assumes no liability for lost or stolen cards. It is the Yogurberry Loyalty card holder’s responsibility to obtain a new Yogurberry Loyalty card from any store and go online to www.yogurberry.com.au/activate and transfer the Yogurberry credit points balance to the new card. Promotions and Discounts 26. Yogurberry Loyalty cards are not valid with any other promotion, discount or offer. 27. On occasions, Yogurberry will run promotions exclusive to the Yogurberry loyalty program. These promotions will be subject to these terms and conditions, unless otherwise specified. 28. Yogurberry points are not awarded when a Yogurberry gift card is purchased. However, the Yogurberry Gift Card recipient (or card holder) will earn Yogurberry credit points on purchases made using their Yogurberry Gift Card provided they are a Yogurberry Loyalty card holder. Fees 29. No fees are charged by Yogurberry for the registration, activation or use of the Yogurberry loyalty program. Complaints Handling 30. While reasonable effort will be made in the restaurants so that points are correctly awarded, Yogurberry takes no responsibility for errors associated with crediting Yogurberry points and it’s credit points onto the Yogurberry loyalty card. 31. We reserve the right to correct the balance of your Yogurberry credit points if we believe a clerical or accounting error has occurred.
