General Terms 1. By using or registering as a Nominom card holder, you consent to the terms and conditions outlined in this agreement. 2. To enjoy the benefits of the Nominom membership programme, you are required to provide Nominom with a valid email address. However, on completing the registration form you can select not to receive emails from Nominom. 3. Nominom accepts no responsibility for incorrect information provided by Nominom card holders on web forms or the like. 4. Only one Nominom card and account is permitted per person or email address. 5. Unless otherwise required by law or permitted by this agreement, points are non-refundable and cannot be redeemed for cash. No interest or any other earnings on funds on a Nominom card will accrue, be paid or be credited to you by Nominom. 6. Nominom reserves the right to refuse use of a Nominom membership card on suspicion of unauthorised, fraudulent or otherwise unlawful use. Where this occurs, the account and card will be cancelled and any points will be lost. 7. Nominom reserves the right to change these terms and conditions at any time without notice. Rate of Reward 8. Nominom points are the currency of Nominom. Nominom points are not legal tender and cannot be used by any other means other than Nominom. 9. Nominom card holders earn and spend (redeem) in Nominom points. 10. Nominom reserves the right to change the rate of reward and value of Nominom points at any time. 11. As of 30/May/2014, for every $1 spent you earn you will receive 0.1 points. Earning Nominom Points 12. To earn Nominom points, you must first collect a Nominom card from any Nominom store and present the card during your transaction. 13. Participants must register their card at www.nominom.com.au/membershipactivate before redeeming Nominom points. 14. For every purchase made, you will be awarded $0.1 Nominom points for every $1 dollar (AUD) spent in a single transaction. 15. Nominom points can NOT be earned on transactions that are already being paid. Redeeming Nominom points 16. To redeem points, you must meet the following criteria; o a) Collect your Nominom Card from any participating Nominom store. o b) Go online to www.nominom.com.au/membershipactivate and select link to “Activate with your Membership Card” and by completing all required fields to complete the registration process. o Present your membership card or mobile number in store at the Point Of Sale o Elect to pay the whole or part of the transaction using your Nominom points. 17. points are redeemable for rewards which consist of any food or beverage products within any participating Nominom store (subject to availability) at the retail price in-store. 18. points cannot be purchased. 19. points can only be earned through accruing Nominom points. 20. Where you wish to use your points for purchases over your Nominom points, you must provide cash or credit card / EFTPOS (where available) to pay the remaining balance. Lost or Stolen cards 21. In the case of a lost or stolen card, you should: o a) Email marketing@nominom.com.au advising of your name, email address and mobile number used to register the card requesting the card to be disabled. o Visit any Nominom participating store and request a new card. o b) Email marketing@nominom.com.au advising of your name, mobile number, new card number and security code (from your profile page and registration email) requesting the new card to be linked to your membership program account. o Do NOT reactive the new card unless you wish to link it to a new account and forfeit your existing points. 22. Nominom will take reasonable steps so that any points on the lost or stolen card are transferred to the new card, however Nominom will not be held responsible for any Nominom points or points that are lost in the transfer. 23. Nominom assumes no liability for lost or stolen cards. It is the Nominom card holders responsibility to obtain a new Nominom card from any Nominom store and email the request to have your new card linked to your old account. 24. During certain promotions, Nominom may choose to increase the rate of Nominom points earned during a transaction. Nominom may notify you of these promotions via email, SMS, on our Facebook page, website or in store. 25. Nominom cards are not valid with any other promotion, discount or offer. At times, and at the discretion of Nominom, Nominom cards may be accepted. Nominom points will be issued on the discounted value of the check. 26. On occasions, Nominom will run promotions exclusive to the Nominom membership program. These promotions will be subject to these terms and conditions, unless otherwise specified. Fees 27. No fees are charged by Nominom for the issue, registration, activation or use of the Nominom membership program. Complaints Handling 28. While reasonable effort will be made in the store so that points are correctly awarded, Nominom takes no responsibility for errors associated with crediting Nominom points and points onto the Nominom membership card. 29. We reserve the right to correct the balance of your Nominom points if we believe a clerical or accounting error has occurred. 30. Contact the Nominom membership team on marketing@nominom.com.au if you have a complaint regarding the membership program and the inability to redeem points at a particular store.
